This document allows the applicant to be recognized as a “participating provider” in the Bright Energy Solutions® incentive programs offered by Missouri River Energy Services (“MRES”) together with their participating member utilities (collectively referred to as “The Utility”). By signing this document, the applicant agrees:
- To comply with the guidelines, procedures, terms and conditions set forth in each program application.
- To provide services or materials which result in the payment of at least two Bright Energy Solutions incentives annually.
- Bright Energy Solutions may publicize and/or distribute the applicant’s name and contact information as a participating Trade Ally in the programs. Participation does not constitute an endorsement of the applicant by The Utility.
- The applicant may not use the name or logo of Bright Energy Solutions, The Utility, or any other participating member utility in any marketing, advertising, or promotional material without written permission.
- To comply with all federal, state and local codes, applicable laws, and licensing requirements.
- Participation as a Trade Ally is valid for the duration of the Bright Energy Solutions programs, unless terminated by the applicant or by The Utility. The Utility reserves the right to terminate the participation of the applicant at any time at the sole discretion of The Utility.
- The Utility reserves the right to refuse incentive payments and terminate participation of a vendor/contractor in the Bright Energy Solutions programs if the vendor/contractor, whether or not a registered Trade Ally, violates program rules.
- The Bright Energy Solutions programs and incentive amounts are subject to change or termination without notice at the discretion of The Utility.
- The Utility does not expressly or implicitly warrant the installation or performance of any equipment used in connection with these programs.
- The acceptance of this application and each customer program incentive application is determined solely by The Utility in its discretion.
- The Utility is not liable for any damage, injury, or loss of life arising from or relating to the removal, installation, or operation of any equipment, or any other action taken by the customer, the Trade Ally, or The Utility, in connection with a project undertaken by the customer or Trade Ally under the Bright Energy Solutions programs.
- To indemnify, defend and hold harmless The Utility from any claims, damages, liabilities and expenses (including reasonable attorneys’ fees) arising from or relating to the Trade Ally’s failure to comply with any of its obligations under this application.
